Signing requirements for legal validity.

RCW 11.125.050 โ€” Uniform Power of Attorney Act

To make your Power of Attorney or Health Care Directive legally binding in Washington State, your signature must be witnessed by one of the following:

A Notary Public

The document is officially notarized with a seal. Highly recommended โ€” banks, financial institutions, and many agencies require a notary stamp to honor the document.

Two Witnesses

Both must be competent, independent adults. They cannot be your relatives, your home care providers, or the people you are naming as your agents in the document.

Not sure which route is right for you? A notarized document is almost always the safer choice โ€” it's more universally accepted and harder to challenge. If you'd like to get your document notarized, reach out and we'll sort it out together.
